Although it is her goal to make her clients successful, Nola Cooper does not guarantee the success of any business endeavor built around your design project.
Email Communications: It is important to note that responding to email inquiries for help/answers is considered chargeable admin/website time.
Website Security: The security of your website is your responsibility. You must keep your plugins and your WordPress version up to date via your website dashboard. If you do not, you risk being hacked. A security plugin can be added, but if it’s added after you have problems, then chances are your problems will continue. We do offer maintenance plans to help you with keeping your site updated, for a monthly fee. However, if you contact us after trouble has begun, we cannot guarantee your site’s security.
Website Content: Writing of website content is not included in your website design. It’s important that your website content be complete and provided to me as early in the process as possible…preferably at the time of our consultation. If you do not have content, and need help with that, I can refer to you someone that can help you.
Time Limits: In the event of any unapproved delay of more than 30 days by the contractor, we will invoice for the greater of either: (1) all work completed up to the date of notification, based upon the percentage of the project finished, including expenses; or (2) 50% of the agreed-upon price plus expenses, and the contract shall be considered fulfilled by Nola Cooper. All incomplete work will remain the property of Nola Cooper. All payments already made by the contractor will first be applied to these charges.
Payments: You will be expected to pay your invoices upon receipt. Nola Cooper Designs does not offer Net 15 or Net 30 payments. Any amount not paid within 10 days of the due date of the invoice is subject to a 10% late fee.
Printing: Print projects do not go into production until your full payment has been received.
Terms of Use and Licensing of Materials
Projects will commence upon receipt of initial payment. All rights to the materials Nola Cooper creates or modifies for a client will transfer completely to that client upon receipt of client approval and full payment. Until approval and full payment is received, the copyrights to all materials created or modified by us for a client will be owned entirely and without reservation by Nola Cooper or our assigns.
Your satisfaction is guaranteed, however this does not mean that continuous revisions are free. If you are not satisfied with your design after you’ve used all of your revisions, please call us to discuss your project, and we will work with you to make certain you receive the design you desire. Should either party terminate a contract (written or otherwise) before completion, 50% of the initial payment will be retained by Nola Cooper, and rights to any designs and/or materials created before the point of termination will belong to Nola Cooper.
To the extent that the work being performed for you relies upon references, or uses any name, trademark, or other intellectual property belonging to any third party, you warrant that you have obtained all necessary right, license or interest in such intellectual property, and have obtained all necessary consents in order that Nola Cooper may use that intellectual property.
You also agree that you will defend, indemnify, save and hold Nola Cooper completely harmless from any and all costs, loses, claims, demands and liabilities, including all attorney’s fees, as well as any errors, omissions and infringements arising from publication, dissemination and use of those materials we create for you, your company, your representatives and assigns, as well as any liabilities asserted against Nola Cooper or any of our assigns, that may arise or result from any service offered, performed or agreed to be performed, or from any product or service sold by you, your company, your representatives or your assigns, in any way.
Nola Cooper retains the unlimited, non-exclusive-right to use copies of your project, at our discretion (for promotional and marketing purposes only-ex. our Portfolio).
Privacy
This privacy policy discloses the privacy practices for nolacooper.com. This privacy policy applies solely to information collected by this web site. It will notify you of the following:
- What personally identifiable information is collected from you through the web site, how it is used and with whom it may be shared.
- What choices are available to you regarding the use of your data.
- The security procedures in place to protect the misuse of your information.
- How you can correct any inaccuracies in the information.
Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.
Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
